Access to information of public importance
The law on free access to information of public importance regulates the right of acess to information of public importance held by the public authorities in order to exercise and protect the public’s interest in knowing such information and achieving a free democratic order and an open society. The institution of the Commissioner for information of public importance has been established as an autonomous state authority with independent exercise of its competences.
The public authority shall without delay and within 15 days from receipt of the request at the latest inform the applicant whether the requested information is in its possession, allow insight into the document containing such information i.e. issue or send to the applicant a copy of the document. If the public authority does not respond to the above request within the deadline, the applicant may lodge a complaint with the Commissioner, except in cases prescribed by the law.
The public authority is under obligation to appoint one or more authorized persons to respond to requests for free access to information of public importance. Consequently, Mr Željko Radivojević has been authorized to act upon such requests on behalf of the Office of the National Security Council and Classified Information Protection.
The authorized person has a duty to receive requests, inform the applicant of the possession of such information by the public authority and give insight into the document containing the requested information, i.e. provide the information in the appropriate manner, deny the request by means of a decision, provide the necessary assistance to the applicants to exercise their rights regulated by the law;
The authorized person is also under obligation to take measures to promote the practice of administering, maintaining, storing and safeguarding information carriers.
